Face of the new Congress

WASHINGTON (AP) ? Politically, the 213th Congress that was sworn in Thursday won't be much of a change from the less-than-stellar 212th Congress it replaces: Democrats picked up a few seats in the House and Senate, but the balance of power is unchanged, with Republicans controlling the House and Democrats holding a majority in the Senate.

Yet a closer look finds that Congress is undergoing some of the changes that have altered the face of America in general, with women and minorities playing increasingly more prominent roles. Here's a breakdown.

___

THE NUMBERS

The House has 233 Republicans and 200 Democrats. Each party should pick up one more seat when two vacancies are filled. Going into the election, the GOP edge was 242-193. Senate Democrats will have a caucus of 55, including two independents, Angus King of Maine and Bernie Sanders of Vermont. Republicans have 45. That's a pickup of two seats for Democrats.

___

WOMEN

The House will have 79 women, including 60 Democrats. At the end of the last session, there were 50 Democratic women and 24 Republican women. The new Senate will have 20 women members, an increase of three. That consists of 16 Democrats and four Republicans. The last Senate had 12 Democratic women and five Republicans.

___

FRESHMEN

With two vacancies to be filled, the House has 82 freshmen; 47 Democrats and 35 Republicans. As of the end of the last session, 87 of 103 freshmen were Republicans. The Senate will include 14 new faces, with nine Democrats and the independent King. Five are women. New senators include Brian Schatz, who was sworn in on Dec. 27 to fill the seat of the late Hawaii Democrat Daniel Inouye.

___

AFRICAN AMERICANS

The House will have 40 African Americans, all Democrats. The number of Democrats is unchanged, although two Republicans will be gone: Allen West, R-Fla., lost his re-election bid, and Tim Scott, R-S.C., was appointed to fill the Senate seat of Jim DeMint, R-S.C., who is retiring. Scott will be the first black lawmaker in the Senate since Roland Burris, who retired in 2010 after filling the Illinois Senate seat of Barack Obama for almost two years.

___

HISPANICS

The new House will have 33 Hispanics, with 25 Democrats and eight Republicans. That's up slightly from last year. The Senate will have three Hispanics: Democrat Robert Menendez of New Jersey, Republican Marco Rubio of Florida and Republican freshman Ted Cruz of Texas.

___

OTHER MINORITIES

The new House will have nine Asian Americans, all Democrats. There are two American Indians: Tom Cole, R-Okla., and Ben Lujan, D-N.M.

___

OTHER FACTS

According to CQ Roll Call newspaper, the average age of House members in the 113th Congress is 57; the average age of senators is 62. It estimates that the House will include some 277 Protestants and Catholics, 22 Jews, two Muslims and two Buddhists. The Senate will have 80 Protestants and Catholics and 10 Jews. The House will have its first Hindu, Rep.Tulsi Gabbard, D-Hawaii. Senate freshman Mazie Hirono, also of Hawaii, will be the Senate's only Buddhist. Also for the first time, white men will be a minority among House Democrats.

Saving money on your mortgage in 2013

Saving money on your mortgage in 2013

Jack Guttentag
Inman News?

Editor's note: This is the first of a multipart series.

This series of articles is about opportunities available to consumers to save money on an existing mortgage, or on a new one they plan to take in the near future. This one is about unexploited refinance opportunities.

Interest rates have been at historically low levels for some time now and some borrowers have refinanced two or three times, but there are others who so far have allowed the opportunity to pass them by. I am not referring to borrowers who can't possibly meet today's standards. They haven't refinanced because they can't. My focus is on those who can refinance profitably but don't for a variety of reasons.

Erroneous beliefs: The following beliefs that prevent or discourage refinancing have been related to me by borrowers. All are false:

  • Borrowers have to wait some minimum period after taking a mortgage before they can refinance.
  • The borrower who refinances loses the benefit of principal payments already made.
  • The borrower who paid points to reduce the interest rate on the current mortgage should wait until such time as the interest savings have at least covered the cost of the points.
  • The borrower who has had a mortgage for a long time has to begin the process from scratch, delaying the period until they are out of debt.
  • It is better for a borrower who has been making extra payments to continue that practice, rather than refinance.

Readers will find explanations of why these notions are wrong on my website at "Valid and invalid reasons for not refinancing."

Unrealistic fear of adjustable-rate mortgages (ARMs): There are borrowers with fixed-rate mortgages (FRMs) who would not profit from refinancing into another FRM, but who would profit from refinancing into a lower-rate ARM -- but they don't because of fear of a possible future ARM rate increase. In many cases, this fear is not justified because the borrower can pay off the loan within the initial fixed rate period on the ARM, which can be five, seven or 10 years.

To execute this strategy, the borrower must have the capacity to make payments larger than the required payment on the ARM. There is always a payment large enough to pay off the loan fully within the initial ARM rate period, the question being the borrower's capacity to make that payment. The previous payment on the FRM might be large enough to do the trick, or it might not.

Even if the borrower can't pay off completely within the initial rate period, paying a higher rate for a few years on a much reduced balance will not come close to wiping out the interest savings during the preceding years.

For more on this topic, read "Refinancing from FRMs into ARMs."

Failure to exploit a profitable investment opportunity: Many mortgage borrowers can't refinance profitably, or think they can't, because their house has declined in value and a refinance would require the purchase of mortgage insurance, which they don't have now. However, if they have investment assets that can be liquidated to pay down their mortgage balance, the rate of return on investment will be far higher than the return they are earning on those assets now. This is called "cash-in refinancing" because the borrower is putting cash into the transaction, as opposed to cash-out refinancing where the borrower withdraws cash.

Here is an example: John has a 6 percent mortgage with 300 months to go and a $100,000 balance, but his house is worth only $100,000, which makes him ineligible for a refinance. However, if he pays down the balance to $80,000, he can refinance into a 4.5 percent loan with closing costs of 2 percent. If he stays in the house for five years, the rate of return on his investment, consisting of $20,000 in balance paydown plus $1,600 in closing costs, would be 9.98 percent. The return is riskless to the borrower.

The return on investment can be calculated using Mortgage Cash-in Refinance Calculator 3f on my site.

Rejected and gave up: Some borrowers have not refinanced because they tried and were rejected, and then gave up. But not all rejections are created equal -- depending on the reason, some deficiencies are fixable. Here are a few:

  • You met the underwriting standards of the federal agencies (Fannie Mae, Freddie Mac, FHA) but not those of the particular lender who rejected you. Some lenders have "overlays" that impose more restrictive requirements than those of the agencies, and where this is the case, you might well be approved by going to another lender.
  • You were rejected because your credit score was too low for reasons that are quickly remediable. Examples would be scores lowered by a reporting mistake, or by credit card balances that are large relative to the maximums.
  • You were rejected because your equity in the property was too small based on a faulty appraisal. A new appraisal obtained through a different lender could provide a different outcome.
  • You were rejected because your debt-to-income ratio was too high and you have the means to reduce it ? for example, by borrowing against a 401(k) in order to pay down other debt.

For more on this topic, see "Refinance rejection: Can anything be done?"

Dave Hyde of the South Florida Sun-Sentinel takes a look at the best and worst of the Dolphins? season.

For the Patriots to get to where they need to be, linebacker Brandon Spikes is going to have to make more plays than he has lately.

Since he?s not having press conferences in New York, Jets coach Rex Ryan might as well enjoy some down time in the Bahamas.

The Ravens are getting healthier, with FB Vonta Leach and G Marshall Yanda feeling better.

The Bengals are fortunate to be able to trust their kicking game heading into the playoffs.

NFL Network analyst and potential Browns personnel candidate Mike Lombardi has ties to several of the Browns? head coaching candidates.

The Steelers signed six players to future contracts, including perpetual Patriots transaction Ross Ventrone.

The Texans were thin and are getting thinner at inside linebacker.

The Colts got five starters and a key backup back on the practice field Wednesday.

Jaguars coaches are unsure if they?re going to be working the Senior Bowl or not.

Titans QB Matt Hasselbeck is comfortable with being Jake Locker?s backup.

Broncos RB Jacob Hester knows from personal experience not to take a long winning streak for granted.

It?s hard to try to find a trend or preference, since Chiefs chairman Clark Hunt hasn?t hired a head coach before.

The Raiders signed six of their practice squaders to future contracts.

The Chargers? first interview for the GM job was with in-house candidate Jimmy Raye.

Cowboys coach Jason Garrett doesn?t sound like a man ready to give up play-calling.

The Eagles signed former Panthers second-round DE Everette Brown, along with CB Trevard Lindley.

Add Redskins director of player personnel Morocco Brown to the Cardinals? GM interview list.

Bears rookie DE Shea McClellin did not disappoint GM Phil Emery (not that you?d expect Emery to bash his first draft pick).

The Lions signed LB Ashlee Palmer and S Don Carey to contract extensions before the end of the regular season.

It?s a good thing RB DuJuan Harris is able to help the Packers, because he was really bad at selling cars.

Vikings QB Christian Ponder is fine, but they?re worried about LB Tyrone McKenzie.

As you might imagine, Falcons coach Mike Smith is glad he?s able to hang onto offensive coordinator Dirk Koetter.

Panthers QB Cam Newton was banged up in the regular season finale, but none of the injuries were serious.

Saints LB Curtis Lofton put his name to the Steve Spagnuolo debate, and said he supports the coordinator of the league?s worst all-time defense.

The Buccaneers still aren?t sure about the status of LB Quincy Black after his neck injury.

Cardinals defensive coordinator Ray Horton has his heart set on a head coaching job ? somewhere.

Bernie Miklasz of the St. Louis Post-Dispatch says to give credit to Rams owner Stan Kroenke for being aggressive in his pursuit of coach Jeff Fisher last year.

For 49ers OLB Aldon Smith, the absence of DT Justin Smith has had a clear impact on his stat line.

CB Brandon Browner is just one of the players coming back for the Seahawks defense.
